- A former employee of a Burger King restaurant could land
in prison for tampering with Whopper sandwiches and sickening at least
one customer.

- Daniel P. Musson admitted Tuesday that he sprayed oven
cleaner on two Whoppers and spit on another in the restaurant at a Thruway
rest stop in Henrietta.

- He also said he saw two fellow employees perform similar
acts over six months ending in April.

- Musson, 18, of Henrietta, pleaded guilty to a felony
charge of first-degree tampering with a consumer product before Monroe
County Court Judge Charles T. Maloy.

- In exchange for the plea and Musson's promise not to
appeal, Maloy said he would sentence Musson to no more than one to three
years in prison and no less than six months in jail and five years' probation.

- The judge also said he would consider granting Musson
youthful offender status, which would seal his criminal record.

- Musson agreed to cooperate against two other former employees
whose cases are pending before a grand jury: Janet M. LaDuca, 18, of Scottsville;
and Scott B. Savino, 20, of Henrietta.

- Assistant District Attorney James Wolford said Musson,
who will be sentenced Nov. 29, will be expected to testify against LaDuca
and Savino.

- The three were fired in early May after another employee
told a manager of food-tampering and a sheriff's deputy was sickened by
contaminated food he ate April 30.

- The deputy suffered from diarrhea, nausea and acid reflux,
in which stomach acid comes up into the esophagus. He was out of work several
days but has recovered, said sheriff's spokesman Jim Pringle.

- Wolford wouldn't disclose whether anyone else was injured.

- "That's still under investigation," he said.

- Musson admitted that he sprayed oven cleaner on two Whoppers
on April 30 before Savino broiled them. He said he left the cooking area
for several minutes, then asked Savino whether the sandwiches had been
served. Savino laughed, Musson said.

- Musson also said he spit on a cooked Whopper.

- He said he saw LaDuca enter a restroom with a Whopper.
After her return, she said she had urinated on it, Musson said.

- Musson also claimed that he saw Savino spit on one Whopper
after it was cooked and spray cleaning products on three others. Savino
also claimed he urinated into a package of uncooked Whopper patties that
were stored in a cooler, Musson said.
