Jeff,

RFID tracking of customers after they purchase an item with an embedded RFID is property rights infringement. When a customer buys an item, lets say a shirt from Wal-mart, they now own that shirt.

The shirt is their personal property as well as all tags, markers and labels that are attached to that shirt. They can do with those items as they please. They can destroy them, rent them or loan them for someone else to use.

The customer can now say to wal-mart (and any other retailer) if you want to use my RFID via tracking it when passing over sensors in their store or any other store you must pay me a user fee. You could charge the store for each time your RFID was scanned and you could charge any dollar amount per use. I am not a lawyer but common sense dictates that my argument is valid. Perhaps you could ask one of your excellent guests to address this salient point in the struggle against abuse of the RFID.
