Further To Jeb's State
Of Emergency

From Jimmy Tango
9-12-3

Hi Jeff

I was reading the article about Jeb's Martial Law

http://www.rense.com/general14/jebdeclared.htm

and I thought I'd do a little digging to see if this Executive Order was still in effect. A Google search took me to the MyFlorida.com search page - and this document:

http://www.hsmv.state.fl.us/ddl/AttachmentB2.doc

It is an attachment to another unknown document in which Jeb decrees Executive Order 2001-300 into effect. In addition to outlining further task forces, etc. in the fight against terrorism, EO 2001-300 begins as such:

WHEREAS, on September 11, 2001, I issued Executive Order 01-262 declaring a State of Emergency in Florida by reason of the combination of terrorist acts that were perpetrated that day; and

WHEREAS, Executive Order 01-262 remains in effect;

Executive Order 2001-300 was signed on October 11, 2001.
So at this date EO 01-262 was still in effect.

I continued a general search and found there was an Executive Order search at the MyFlorida.com site. Keying in 01-262 gave me 4 returns:

1. Executive Order 01-262 dated September 11, 2001.
2. Executive Order 01-334 dated November 8, 2001 that extends EO 01-262 a further 60 days.

(Note: I am Canadian, and have very little experience with Florida law (thank God). I wasn't sure how long an Executive Order would remain in effect for but I deduced from EO 01-334 that unless otherwise noted an Executive Order will remain in effect for 60 days. If this is the case it would seem to make the declaration in EO 2001-300 redundant. Hopefully someone can clarify this.)

3. Executive Order 02-01 dated January 7, 2002 further extending EO 01-262 another 60 days.
4. Executive Order 02-138 dated May 7, 2002 further extending EO 01-262 another 30 days.

There were no other Executive Orders referencing EO 01-262 beyond May 7, 2002, thus it would seem that Martial Law ended in Florida June 7, 2002. Unless.... Take a close look at numbers 3 and 4.

Now like me you probably figured out that from January to May is more than 60 days. EO 02-138 states that EO 01-262 was 'lately extended' by another Executive Order, 02-82. I searched for EO 02-82 by number and date (Jan-Mar 2002) and came up with nothing. It would be interesting to read Executive Order 02-82 to see if it simply extended EO 01-262 another 60 days or if it went further. Perhaps one of your other readers can help locate a copy of EO 02-82 and help clear up this mystery.

Keep up the good work, Jeff.

JT
